Terms of Service
1. Agreement
By creating an account or using Flexus TrackMail (the website, web app, Outlook add-in, or Gmail Chrome extension), you agree to these Terms and our Privacy Policy.
2. The service
Flexus provides email engagement tracking (opens and clicks), contact-thread analytics, optional reminders, schedule send, notifications, and billing for workspaces. Features may differ by plan (Free, Trial, Pro).
3. Accounts & authentication
You must sign in with Microsoft (Outlook) or Google (Gmail). You are responsible for activity under your account and for keeping OAuth access secure. You must provide accurate account information and use a work or personal email you control.
4. Acceptable use
- Use tracking only for email you are authorized to send and monitor.
- Do not use Flexus to violate anti-spam, privacy, or marketing laws (including CAN-SPAM, CASL, GDPR marketing rules, or similar).
- Do not attempt to probe, disrupt, or reverse engineer the service beyond permitted interoperability.
- Do not resell the service or share API credentials outside your organization without permission.
5. Plans, trial, and billing
- Trial — new accounts receive a 7-day Pro trial without a credit card unless we state otherwise.
- Free — after trial, tracking may continue with a Flexus watermark on tracked emails.
- Pro — billed via Stripe at the then-current price (currently $2 per user / month) for assigned seats.
Fees are charged by Stripe. Taxes may apply. Seat quantities and renewals are managed in the billing portal. Failure to pay may downgrade your workspace to Free.
6. Customer content
You retain rights to your email content and recipient lists. You grant Flexus a limited license to process that content solely to provide the service (for example storing subjects, injecting tracking elements you request, and logging engagement events).
7. Third-party services
The service depends on Microsoft, Google, Stripe, and hosting providers. Their terms and availability affect features such as OAuth, Graph/Gmail send, and payments. Flexus is not responsible for outages or policy changes by those providers.
8. Intellectual property
Flexus TrackMail, including software, branding, and documentation, is owned by Flexus Solutions or its licensors. These Terms do not transfer ownership to you.
9. Disclaimer
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Open tracking is inherently imperfect because of image blocking, privacy proxies, and client behavior.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLEXUS SOLUTIONS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE THREE MONTHS BEFORE THE CLAIM.
11. Termination
You may stop using the service at any time. We may suspend or terminate access for violation of these Terms, non-payment, or risk to the platform. Upon termination, your right to use the service ends; sections that by nature should survive will survive.
12. Changes
We may update these Terms. Material changes will be reflected by the “Last updated” date. Continued use after changes constitutes acceptance.
13. Governing law
These Terms are governed by the laws applicable to Flexus Solutions’ principal place of business, without regard to conflict-of-law rules, unless mandatory consumer law in your country says otherwise.
